This Legal Notice applies to all purchases made through tuksouth.com and sets out the legal information required under applicable EU and UK regulations, including the EU General Product Safety Regulation (GPSR), the EU Consumer Rights Directive, and the UK Consumer Rights Act 2015.

2. General Product Safety Regulation (GPSR) — EU Compliance

In compliance with Regulation (EU) 2023/988 on General Product Safety (GPSR), which has been in force since 13 December 2024, Tuk South confirms the following:

2.1 Responsible Persons

As a non-EU seller supplying consumer products into the European Union, Tuk South has appointed the following EU Responsible Persons in accordance with Article 4 of the GPSR:

The EU Responsible Person is the point of contact for all product safety enquiries, market surveillance authorities, and regulatory matters within the EU.

2.2 Product Identification

All Tuk South products are manufactured on a print-on-demand basis by Printful, sourced from ethically certified blank garment suppliers. Products are identified by:

Product title and description on each product listing page
Material composition (e.g. 100% Cotton)
Country/countries of manufacture (as stated in each product description)
Batch/order reference number provided at time of purchase

2.3 Manufacturer Information

Blank garments are sourced from Printful's supplier network. Sourcing countries include Honduras, Nicaragua, Haiti, Dominican Republic, Bangladesh, El Salvador, and Mexico, depending on the product. Full traceability information is included in each product description.

2.4 Product Safety Compliance

All products sold by Tuk South meet the following safety standards:

Flammability requirements
Lead content limits
Cadmium content limits
Phthalates limits
Formaldehyde level requirements
Contains 0% recycled polyester (where stated)
Contains 0% dangerous substances (where stated)

2.5 Age Restrictions

Unless otherwise stated on the product listing, all Tuk South products are intended for adults only.

3. EU Statutory Warranty — 2-Year Legal Guarantee

Consumers in the European Union and European Economic Area are entitled to a minimum 2-year legal guarantee under EU Directive 1999/44/EC (as updated by Directive 2019/771/EU). This guarantee covers goods that are defective, not as described, or not fit for purpose at the time of delivery.

If a product is found to be defective within 2 years of delivery, you are entitled to:

Repair or replacement of the product (at no cost to you), or
A price reduction or full refund if repair/replacement is not possible or would cause significant inconvenience

To make a warranty claim, contact us at tuksouthcrew@gmail.com with your order number and a description of the defect. This statutory guarantee does not affect any additional commercial guarantees we may offer.

4. EU Right of Withdrawal (Cooling-Off Period)

If you are a consumer resident in the EU or EEA, you have the right to withdraw from your purchase within 14 days of receiving your goods, without giving any reason, under EU Consumer Rights Directive 2011/83/EU.

4.1 How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, notify us within 14 days of delivery by emailing tuksouthcrew@gmail.com with your order number and a clear statement of your decision to withdraw. You may use the model withdrawal form below, but it is not obligatory.

4.2 Return of Goods

After notifying us of your withdrawal, you must return the goods within 14 days. Items must be returned unused, unworn, and in their original condition. You are responsible for the direct cost of return shipping unless the item is faulty or not as described.

4.3 Refund

We will process your refund within 14 days of receiving the returned goods (or evidence of return), using the same payment method as your original purchase. We may withhold the refund until we have received the goods.

4.4 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to goods made to your specifications or clearly personalised, in accordance with Article 16(c) of Directive 2011/83/EU. As our products are made to order on a print-on-demand basis, personalised or custom-designed items are exempt from the right of withdrawal.

5. UK Consumer Rights

If you are a consumer resident in the United Kingdom, your statutory rights are protected under the Consumer Rights Act 2015. You are entitled to goods that are of satisfactory quality, fit for purpose, and as described. If goods do not meet these standards, you may be entitled to a repair, replacement, or refund. These rights are not affected by our returns policy.

6. Packaging & Packaging Waste Regulation (PPWR)

Tuk South products are fulfilled and shipped by Printful, who acts as the packer and shipper of all orders. Packaging compliance under EU Regulation 2025/40 (PPWR), including any Declaration of Conformity requirements effective from 12 August 2026, is the responsibility of Printful as the packaging operator. Tuk South is in the process of confirming Printful's PPWR compliance status and will update this notice accordingly.

7. Textile Labelling & Fibre Composition

In accordance with EU Textile Regulation (EU) No 1007/2011 and UK equivalent regulations, fibre composition and material information for all products is disclosed on each product listing page. All products are labelled with their material composition (e.g. 100% Cotton) and country of manufacture where known.

8. Data Protection & Privacy

Tuk South processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR 2016/679), and the UK Data Protection Act 2018. 9. Dispute Resolution

9.1 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers in the EU: https://ec.europa.eu/consumers/odr. Our email address for ODR purposes is tuksouthcrew@gmail.com.

9.2 UK Alternative Dispute Resolution

If you are a UK consumer and we are unable to resolve a complaint to your satisfaction, you may refer your complaint to an approved Alternative Dispute Resolution (ADR) scheme. Please contact us for further information.

10. Governing Law

These terms and this Legal Notice are governed by the laws of England and Wales. Nothing in this notice affects your statutory rights as a consumer under the laws of your country of residence.
