Terms of Service

1. About Us

This store is operated by Tuk Off South Ltd, a company registered in Kenya (Business Registration No. PVT-V7UYBB7R, VAT No. P052059338H), with its registered address at PO BOX 477, Nanyuki, Kenya, 10400. Tuk Off South Ltd trades as “Tuk South” and documents an ongoing overland expedition, selling branded merchandise to support and share the journey.By accessing or purchasing from tuksouth.com, you agree to these Terms.

2. Products & Fulfillment

All items are made to order through our production partners, including Printful (fulfilling from the USA and EU) and Kitu Kali (fulfilling East African orders from Kenya), depending on your shipping destination. Colors, materials, and print placement may vary slightly from product photos due to the nature of print-on-demand manufacturing. We reserve the right to substitute a comparable blank garment if a specific product becomes unavailable, and will notify you if this affects your order.

3. Pricing & Payment

Prices are displayed in the currency shown at checkout, which may be automatically adjusted based on your location. All prices include applicable VAT where required by law and exclude import duties (see Section 4). Payment is processed securely through our payment provider at checkout; we do not store your full card details. Orders are confirmed only once payment is successfully processed.

4. Shipping & Delivery

Shipping rates, zones, and estimated delivery times are set out in our Shipping Policy. Delivery estimates are provided in good faith and are not guaranteed, as actual delivery depends on customs processing and local carrier performance outside our control. International orders may be subject to import duties or taxes payable by the customer, not included in the order total.

5. Returns & Refunds

Due to the made-to-order nature of our products, we do not accept returns or exchanges for change of mind. Full details, including defective item procedures, are set out in our Returns Policy.

6. EU Consumer Rights & Withdrawal

If you are a consumer resident in the European Union, you have a statutory right to withdraw from your purchase within 14 days of receiving your goods, without giving any reason, under Directive 2011/83/EU and Directive 2023/2673. This right is exercised through the self-service cancellation option provided at checkout/order level, or using the model form below.

Where a product is made to your specifications or is clearly personalized, this right does not apply, in accordance with Article 16(c) of the Directive. Exempt products are marked accordingly on the product page.

7. Intellectual Property

All content on this site — including the Tuk South name, logo, expedition photography, video content, and product designs — is the property of Tuk Off South Ltd and may not be reproduced, distributed, or used commercially without prior written permission.

8. Acceptable Use

You agree not to use this site unlawfully, to interfere with its security or functionality, or to submit false or fraudulent orders.

9. Limitation of Liability

To the fullest extent permitted by law, Tuk Off South Ltd is not liable for indirect, incidental, or consequential damages arising from your use of this site or purchase of our products, including delays caused by third-party carriers, customs authorities, or production partners. This clause does not exclude or limit any liability, or any statutory consumer right, that cannot be lawfully excluded — including your rights as an EU consumer, which apply regardless of this clause.

10. Governing Law

These Terms are governed by the laws of Kenya. This does not affect the mandatory consumer protection rights you are entitled to under the law of your country of residence if you are a consumer resident in the EU, UK, or elsewhere, which continue to apply regardless of this clause.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
